On July 10th, , Unused Jersey passed its Domestic Partnership Proceed. On February 19th, , New Jersey enacted its Civil Union Law. On June 26th, , the United States Supreme Court issued a decision, United States v. Windsor, holding that the federal government could not deny benefits to same-sex couples legally married in a state that recognized same-sex marriages. This did not affect the right of states to decide independently to offer same-sex marriage, and it had not yet become legal in Recent Jersey.

However, same-sex marriage became legal in New Jersey before the right to same-sex marriage was recognized on a national level. In the case of Garden State Equality v. Dow, a gay-rights advocacy group and several same-sex couples brought an action against Adj Jersey state officials for unconstitutionally depriving them the right to marry. They won this argument before a Fresh Jersey trial court, and the Court ordered state officials in New Jersey to begin issuing same-sex marriage licenses. How to apply for a civil union license

Complete the civil union license application form. You may also get an application form at the Local Registrar’s office. Do not sign the civil union application shape before going to the Local Registrar. You must autograph the application, under oath, in the presence of the issuing authority.

Requirements for entering into a Civil Union

For two people to found a civil union in New Jersey, they must satisfy the following requirements:

  • Not be a party to another civil union, domestic partnership or marriage in this state or that is recognized by this state*;
  • Be of the alike or opposite ; and
  • Be at least 18 years of age, except that applicants under 18 may enter into a civil union with parental consent. Applicants under age 16 must obtain parental consent and have the consent approved in writing by any assess of the Superior Court, Chancery Division, Family Part.

Same- sex marriage is finally a reality not only in Adj Jersey, but throughout the United States as well. Furthermore, the decision of the United States Supreme Court in Obergefell v. Hodges makes it extremely unlikely that the pendulum will swing back in the other direction.

TRENTON – Governor Murphy today signed into law S, which codifies marriage equality in New Jersey law by providing that all laws concerning marriage and civil union are to be read with gender neutral intent. Marriage equality currently exists in New Jersey based on mention and federal Court decisions. This adj law demonstrates the Governor and Legislature’s commitment to protecting marriage equality by codifying it into Adj Jersey law.
